If I don't hear back from Notion Ink today, I am calling the credit card company. It's that simple. I tried to cancel my order 5 days ago.
I'm just about at the end of my patience too. I've tried to believe in NI and trust them but I've requested an update today. If I don't get a REAL update then I will be reporting this purchase as fraud to Visa. Damn.

Depends on Visa's view of your statutory rights. My bank has suggested that Notion Ink's terms and conditions might be non-enforceable because they contravene generally recognised International statutory consumer rights.
When they charge your card, legally they've exhibited "consideration." In other words, by accepting your offer (and payment), they've entered into a contract. Part of that contract is to send you the device you ordered within the indicated time-frame. If they don't, they are breaching the contract and are liable for the whole amount.
